House inspection gone bad do we need to send to realtor?

We made an offer on the house and the offer contract had a inspection contingency on it and says that it if it is not to the buyers (us) satisfaction then the contract is void. So we got the house inspected and paid the ernest money. The inspection came back bad and we told the realtor we wanted our earnest money back and would not be buying the house. She said that we need to send the inspectors report to the listing agent. Legally, do we have to do that in order for us to get our earnest money back?
